Employment Of Foreign Workers In Malaysia

The Government of Malaysia issues three different types of Employment Pass [Work Permit] to foreign nationals.

The Employment Pass (EP) is a work permit that enables an expatriate to take up employment with an organisation in Malaysia. The pass is subject to the contract of employment (up to 60 months).

The Expatriate Committee (EC) or relevant authorities must give approval for the foreign talent to fill a position before the issuance of an expatriate Employment Pass can be made by the Immigration Department of Malaysia.

 

Types of Employment Pass in Malaysia

 

Work Permit in Malaysia is issued to Foreigner who is qualified to fulfill the following position and are considered to be expatriates.

a. Key Post
# Top Managerial Post of a foreign owned company operating in Malaysia.
# Responsible to look after the company’s interests and investments.
# Responsible in determining the company’s policies and goals.

b. Executive Post
# Professional / Middle Managerial Post.
# Required academic and working experience, practical skills related to the respective jobs.
# Responsible in implementing the company’s policies and supervision toward the junior staff.

c. Non-Executive Post
# Highly skilled
# Require working experience and technical skills related to the respective jobs.

 

Procedures on Employing an Expatriate

There are 2 stages of the application when employing an Expatriate:

1st Stage – Application of Expatriate Post (DP10)

2nd Stage – Application for Employment Pass
