The two – Abd Faiz Hannan Ibrahim, 24 and Adly Affandy Abdul Rahim, 34 – stand accused of committing the offence at the air entry control counter on level 3 of KLIA’s arrival hall.
Faiz, who is from Penampang, Sabah, was charged with smuggling in Bangladeshi Abdul Momen at about 10.30am on Nov 20.
Adly Affandy, from Semenyih, is alleged to have smuggled in two Bangladeshis – Md Mosarof and Ashabul Haque – between 8.30am and 9.30am on Dec 6.
The two officers were charged under Section 26A of the Anti-Trafficking in Persons and Smuggling of Migrants (ATIPSOM) Act 2007 for migrant smuggling.
If found guilty, the two could be jailed for not more than 15 years and fined.
After the charges were read before sessions court judge Saifulakmal Mod Said, both immigration officers pleaded “not guilty.”
Following a request by the deputy public prosecutor Ungku Alfiati Zabeidah Ungku Ismail, Saifulakmal decided to transfer the case to the Shah Alam Court.
However, no date was fixed to transfer the case.
Faiz was not represented, while Adly Affandy was represented by lawyer Zafran Zafri Mohd Zaini.
Later, Zafran said his client could not be released on bail because he was bound by the Security Offences and Special Measures Act (Sosma).
Handcuffed and escorted by the police, the two arrived at the Sepang sessions court at about 10am.
Also present at the proceeding was Adly Affandy’s family.
