FAQs on Act 446

(Workers’ Minimum Standards of Housing and Amenities Act 1990)

This Act came into force on 1 June 2020.

This Act applies to:

  • Employers
  • Centralized accommodation providers
  • All employment sectors throughout Peninsular Malaysia and the Federal Territory of Labuan.

The Act aims to:

  • Cover all employment sectors.
  • Set minimum housing and facility standards for workers in line with international standards.
  • Address forced labor concerns.
  • Protect workers' rights and welfare related to accommodation.
  • Enhance worker safety and health regulations.
  • Ensure systematic and conducive worker accommodation for national development planning.

All accommodations and centralized accommodations must obtain an Accommodation Certificate from the Director General of Manpower.

No, they do not require an Accommodation Certificate.

  • Employer: Fine not exceeding RM50,000.
  • Centralized Accommodation Provider: Fine not exceeding RM50,000 or imprisonment up to 1 year, or both.

A. BEFORE APPLICATION AT JTKSM
i. Documents that need to be prepared:
a) If Building an Accommodation Building
  • Certificate of Completion and Compliance (CCC) from PBT.
b) If a Temporary Building or a Non-Residential Building
  • Approval of a Building Permit for a limited period from PBT.
  • Approval to Change Building Conditions or Building Modification Approval from PBT.
c) If the Building is Rented
  • Approval or permission from PBT (if applicable).
B. APPLICATION AT JTKSM (STATE OFFICE OR DISTRICT OFFICE NEAR THE ACCOMMODATION)

i) 2 copies of the Application Form (AC1) can be downloaded from the website http://jtksm.mohr.gov.my/

ii) Processing on behalf of the Director General of Manpower as in the following table:
